Sikkim High Court disposed of PIL filed against the construction of 300 bedded hospital at Veterinary playground, Namchi. “ Bhaichung Stadium can be used by the general  public for the purpose of health activities besides football tournaments and in addition to that the State Government has allotted 3.822 acres of land in Boomtar, Namchi, for utilization of public purpose of sports, etc., we do not find any cogent and/or justifiable reason to keep the instant Public Interest Litigation pending, which stands disposed of accordingly” observed the High Court of Sikkim on February 17

The Petition was filed before the High court of Sikkim on September 9 which stated that, “The Petitioners belonging to different walks of life and public-spirited citizens are aggrieved by the proposal of the State Government to construct a 300 bedded District Hospital at Namchi, South Sikkim, on a playground popularly known as “Veterinary Ground”. It is submitted by Learned Senior Counsel that Namchi does not have sufficient open space and the earlier proposal of extending the old Hospital could be implemented instead of impinging on the Playground”

In which the High Court ordered the State Government to file counter affidavit within 6 weeks time period.

In the process the state government filled its counter affidavit and in  paragraph 14 of its reply to the High court stated that, “It is further submitted that Government has already taken care of sports, therefore, Bhaichung Stadium has constructed and completed, which is of international standard and same can be utilized by the people for the purpose of health activities, besides football tournament, there is no bar. In addition to that, State Government has allotted 3.822 acres of land at Boomtar Namchi for utilization of public purpose of sports etc.”

“That the contents of paragraph- 50 of the writ Petition are matters of record, and it is submitted that the Bhaichung Bhutia Stadium which is meant for sports activities, its construction has been completed, and the said stadium is also being used by the public of Namchi Bazaar and as well as by the public of in and around vicinity of Namchi, South Sikkim” reads paragraph 26 of state government’s reply

Following to which in the hearing of February 17, 2022 the high court dismissed the petition filed against the state  government. “We do not find any cogent and/or justifiable reason to keep the instant Public Interest Litigation pending, which stands disposed of accordingly” stated HC in its judgment
