No land transfer between Sikkimese to Non Sikkimese without govt approval

Sikkim Government to take strict action against Sub Registrars who is registering land transfer between Sikkimese to non Sikkimese without prior approval of the state government.

Department of Land Revenue and Disaster management through circular dated February 28 stated, “It has come to the notice of the higher authority that, some instances of Agreement/ Deeds in respect of transfer of land/property from Sikkimese to non- Sikkimese have been registered by some Sub Registrars without prior approval of the Government thereby resulting in major lapses of registration procedure under Sikkim State Rules for Registration of Documents, 1930.”

“Such actions on the part of any Sub- Registrar is gross violation of Sikkim State Rules for Registration of Documents, 1930 which is protected under Article 371 F of the Constitution and same is being viewed very seriously as violation of Old Laws.” Added the statement

Furthermore, the circular also stated that, “If any Sub Registrar is found guilty of such offence strict action will be initiated against the official under the relevant provisions of Sikkim Government Servant’s (Discipline and Appeal) Rules, 1985 along with relevant sections of Indian Penal Code, 1860.”
