8-yr-old minor girl sexually assaulted by school students;case filed under the POCSO Act

According to a situation report shared by Gangtok District Police, on November 18, police received a written complaint alleging that some school students had been sexually assaulting a 8-year-old minor girl.

In the complaint, it had been mentioned that on November 18, at around 4:00 PM, the said minor child was missing from her home, and when the complainant went to search for her, the minor was found just below the School Road in Gangtok District.

After the minor was questioned, she revealed that one boy from the said school has been sexually assaulting her in the jungle near the school and at his house for the past 2 months.

Further the police report revealed that the said boy had been threatening her with dire consequences if she revealed the sexual assault to anyone.

The minor also stated that there were four other big boys from the same school who were sexually abusing her.

On the date the FIR was received, it was revealed that the said boy had asked her to come over to his house, after which he told her to open her clothes, and then he sexually abused her by inserting his penis into her vagina.

The complainant came to the police station in Gangtok district and lodged an FIR to take necessary action against the alleged culprits after knowing about the incident.

The case is registered under Section 506 (Punishment for criminal intimidation) and Section 34 (Acts done by several persons in furtherance of common intention) of the Indian Penal Code, along with Section 5(l) (whoever commits penetrative sexual assault on the child more than once or repeatedly), Section 5(M) (whoever commits penetrative sexual assault on a child below twelve years of age), and Section 6 (Punishment for aggravated penetrative sexual assault) of the POCSO Act, 2012.

According to police sources, the case is under investigation, and so far, no one has been arrested.
